Welcome to Terravua. By accessing or using our website (www.terravua.com) and any related services, you agree to be bound by these Terms and Conditions (“T&C”). If you do not agree, you may not access or use this site.

1. Use of Website

1.1. This website is intended for persons over the age of 18. By using this site, you confirm you are legally capable of entering into binding contracts.
1.2. You may use this site only for lawful purposes and in compliance with these T&C.
1.3. Terravua reserves the right to restrict or terminate access if we reasonably believe a user has violated these T&C.

2. Products and Services

2.1. Terravua provides geotextile products, dewatering and sludge capping solutions, coastal protection technologies, and civil engineering/construction services.
2.2. All product descriptions, pricing, availability, and specifications are subject to change without notice.
2.3. Images and descriptions on the website are for illustration purposes only. Actual products may vary.

3. Quotations, Orders, and Payments

3.1. All quotations are valid for 30 (thirty) days unless otherwise specified.
3.2. Orders shall be deemed accepted and binding upon written confirmation by Terravua or upon commencement of supply, manufacture, dispatch, or invoicing, whichever occurs first.
3.3. Payment terms are as specified on each quotation or invoice (e.g., deposit or COD). Late payments may attract interest charges.
3.4. All prices are quoted in South African Rand (ZAR) unless otherwise stated and may be subject to fluctuations due to exchange rates, tariffs, or import/export duties.

4. Shipping and Delivery

4.1. Shipping and delivery are at the Client’s cost unless otherwise agreed in writing.
4.2. Delivery times are estimates only and may vary due to shipping line schedules, customs clearance, or unforeseen events. Terravua will not be liable for delays beyond our reasonable control.
4.3. Risk of loss passes to the Client upon handover of goods to the carrier. Insurance may be arranged at the Client’s request and expense.

5. Warranty and Returns

5.1. Terravua warrants products against defects in material and workmanship for 12 (twelve) months from delivery, under normal use and service.
5.2. Exclusions include misuse, improper installation, unauthorised modifications, and natural wear and tear.
5.3. Returns are accepted only with prior written approval, in original condition, and within 7 (seven) days of delivery. A restocking fee may apply.
5.4. Terravua’s liability is limited to repair, replacement, or credit at our discretion.

5.5  Custom-manufactured, made-to-order, or site-specific products (including but not limited to geotextile tubes manufactured to project dimensions or specifications) are non-cancellable and non-returnable once manufacture has commenced.

6. Intellectual Property

6.1. All content on this website, including text, images, logos, graphics, and designs, is the property of Terravua or its licensors.
6.2. No content may be copied, reproduced, modified, or distributed without prior written consent.

7. Limitation of Liability

7.1. Terravua shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, delays, or business interruptions.
7.2. The Client is responsible for ensuring products are suitable for the intended use.

7.3. Terravua does not guarantee performance outcomes, dewatering efficiency, production rates, or project results, which are dependent on-site conditions, material characteristics, operational practices, and factors beyond Terravua’s control.

8. Privacy & Data Protection

8.1. Terravua respects your privacy. Personal information collected through this site will only be used in accordance with our Privacy Policy.
8.2. By using this site, you consent to the processing of your personal data as outlined in our Privacy Policy.

9. Changes to Offerings & T&C

9.1. Terravua reserves the right to modify, suspend, or discontinue any product or service at any time without notice.
9.2. We may update these T&C from time to time. Continued use of the website after changes implies acceptance of the revised T&C.

9.3. The version of these Terms & Conditions published on the Terravua website at the date of issue of the applicable quotation shall apply to that transaction.

10. Governing Law & Jurisdiction

10.1. These Terms & Conditions are governed by the laws of the Republic of South Africa.
10.2. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.

11. Force majeure

11.1. Terravua shall not be liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to acts of God, strikes, port congestion, customs delays, supply chain disruptions, or government actions.
